Khattak complains of `one-sided` stay orders

Bureau Report 2014-01-04
PESHAWAR: Khyber Pakhtunkhwa Chief Minister Pervez Khattak on Friday said the one-sided stay orders issued by the lower judiclary in posting and transfer of government servants and other official issues had been hampering the efforts of the government to ensure good governance and quick disposal of day-today official business.

`Issuing one-sided stay orders without hearing the official version is against the established norms of judiciary,` he told a delegation of Khyber Pakhtunkhwa Bar Council during a meeting here.

KPBC Vice Chairman Amjad Shah led the delegation.

According to official handout, the chief minister expressed the hopethat the increasing tendency of one-sided stay orders by the lower judiciary in matters related to the postings and transfers of government employees and other official matters would be discouraged.

He said the chief justice of the Peshawar High Court recently issued instructions to the lower judiciary not to issue one-sided stay orders.

Mr Khattak urged lawyers to play their role in this regard and suggested to the office-bearers of the bar council to sit together with the high-ups of Peshawar High Court, the law department and the advocate general to formulate a criteria to ensure the implementation of the rules in vogue and discourage the practice of one-sided stay orders.

The delegates agreed to the points of the chief minister and assured him of their full cooperation to that effect.

The chief minister called upon lawyers and their elected bodies to join hands with the provincial government in its efforts to eliminate corruption from the society and provide cheap and quick justice to the people.

While terming lawyers an impor-tant segment of society, he said the role in the dispensation of justice to the people and upholding the supremacy of the law was the most significant role they played and that the provincial government would take concrete measures to resolve their problems on priority basis for the same reason.

Mr Khattak, on the complaint of the delegation, directed the high-ups of the communication and work department to ensure early completion of work on the building of the bar council in Peshawar.

He said elimination of corruption, exploitation, injustices and other social evils were among the top priorities of the provincial government`s agenda and that no wrong would be done to anybody, including the government employees, during his government.

The chief minister also said corruption by anybody would not be tolerated.

`We will keep the competent, honest, fair and hard working officials in high esteem. There will be no room for corrupt and incompetent officials in his government,` he said.
