Court told about flaws in Haleema murder case probe

KARACHI: The police submitted on Friday a supplementary charge sheet in a case pertaining to mysterious death of a woman and highlighted flaws committed during the initial investigation.

The partially-decomposed body of Haleema was found in her flat in Delhi Colony on May 31 while her around three-year-old son Abdullah was admitted to the Edhi Centre by Rizwan Ayaz Khan, said to be the main suspect, on May 25. He claimed that the child had been found abandoned near Do Darya.

Rizwan and his wife Sonia were booked in the case and later remanded in prison.

The police had filed an interim charge sheet on June 16 declaring Rizwan as an alleged murderer while requesting the court to release Sonia on the grounds that no clue was found against her.

However, a judicial magistrate had not entertained the police plea to release the female suspect and directed the IO to file the final report.

But, he failed to submit the report within the given time. Subsequently, on June 25, the magistrate treated the interim charge sheet as final one and sent the case to the sessions court for trial. Later, the IO had also moved the sessions court to again get the custody of Rizwan for questioning.

On Friday, present IO Hameed Khan submitted a supplementary charge sheet in which he named Rizwan as the prime suspect. The IO said that he also charge-sheeted Soina in order to comply with an order of the magistrate.

The supplementary report said that Rizwan told the police in the presence of media that he killed Haleema in order to save his first marriage since the victim had been forcing him for marital alliance.

The IO also submitted an additional two-page report in the court in an attempt to justify the submission of the supplementary charge sheet.

According to the report, SubInspector Walayat Hussain of the Frere police station had neither collected any evidence during inspection of the crime scene and body nor completed the fingerprint process, and now the present IO could not collect any data or evidence at this stage.

The report further said that a misconduct report against second IO SI Nasrullah was sent to high-ups sincehe produced the suspect before the court a day after his arrest for confessional statement without completing therestoftheinvestigation andother key legal formalities.

The second IO committed misconduct since he was aware that the court will send the suspect to prison af ter the statement, it added.

The police had shown Rizwan arrested on June 9 and on the following day the visibly confused IO had simultaneously moved an application to record the confessional statement of the suspect under Section 164 of the criminal procedure code and a remand paper seeking custody of the suspect for questioning regardless of the fact that the court was bound to remand the suspect to prison after taking up 164 CrPC application whether he confess or not.

However, the suspect declined to confess before the magistrate and said that the police were forcing him record his confession. Subsequently, the court sent him to prison.

A case was registered against the couple under Sections 302 (premeditate d murder) and 34 (common intention) of the Pakistan Penal Code on a complaint of the deceased`s brother at the Frere police station.

Charge sheet against Uzair Baloch The police submitted on Friday a charge sheet against chief of the banned Lyari Peoples Aman Committee Uzair Jan Baloch and others in a case pertaining to the murder of a police officer.

Uzair along with his detained and absconding accomplices has been booked for allegedly killing the then SHO of Civil Lines Fawad Khan and injuring five other policemen during an operation conducted in Lyari in April-May 2012.

The investigating officer filed the charge sheet in the court of administrative judge of the antiterrorism courts Karachi against Uzair; Ramzan, alias Ramzani; Abdul Ghaffar; Habib Baloch and Zakir Dada and shown around 20 others as absconding accused.

The administrative judge sent the case to an ATC for trial.

Uzair Baloch, who is facing multiple cases, including the murder of his archrival Arshad Pappu, was detained by Rangers under 90-day preventive detention following his mysterious arrest in January.

After the end of his detention, the paramilitary force handed him over to police.
