Bail denied to facilitator of 2013 Judicial Complex attackers

2015-08-28
PESHAWAR: The Peshawar High Court on Thursday dismissed the ball petition of an internally displaced person arrested by the counter-terrorism department on the charge of facilitating suicide bombers, who had killed four people and injured 37 by attacking the Peshawar Judicial Complex over two years ago.

Justice Asadullah Khan Chamkani of a single-member bench observed that keeping in view the case record, the petitioner, Iran Shah, a resident of Bara, Khyber Agency, didn`t deserve to be freed on bail. Two suicide bombers had attacked the Peshawar Judicial Complex on March 18, 2013.

They had first entered a car parking meant for lawyers near the high court and Judicial Complex building and barged into the complex by firing gunshots at the police personnel deployed there.

One bomber was shot dead by a policeman, whereas the other blew himself up on the second floor of the complex at the entrance of the courtroom of an additional district and sessions judge. A state counsel opposed the bail petition and argued that few days ago, the counter-terrorism department had arrested a key suspect in the case, Abdul Ghafoor.

He added that the said suspect had named the present petitioner, Iran Shah, as the facilitator of the two bombers.

The state counsel said the petitioner was a resident of Bara and that he had provided bombers an overnight stay at his residence before the attack.

He said after the launch of military operation against militants in Bara, the petitioner became an IDP and had taken shelter at an IDP camp here, where he was arrested.

The lawyer said four innocent persons were killed and scores of others suffered injuries in the suicide attack and therefore, the petitioner did not deserve any leniency and was not entitled to the concession of ball.

He said he was falsely implicated in the case as there was no evidence on record to support contention of the lawenforcement agencies. The lawyer said the case of the prosecution was based on hearsay. Bureau Report
