KP forms body in missing persons` case

ISLAMABAD: Following in the footsteps of federal government, the Khyber Pakhtunkhwa government has formed a committee to identify those responsible for removing 35 missing persons from the Malakand Internment Centre.

Led by the provincial home secretary, the threemember committee would complete its inquiry in seven days, KP`s Advocate General, Latif Yousafzai, told a three-judge bench of the Supreme Court headed by Justice Jawwad S.

Khawaja.

The bench had taken up the case of a missing person, Yasin Shah, on the application of his brother Muhabbat Shah. On Dec 10 lastyear,the apexcourt had held the army authorities responsible for removing 35 persons from the internment centre, of whom only seven were produced before the court.

At the last hearing on Jan 27, the attorney general informed the bench about the appointment of a oneman commission comprising former Supreme Court judge retired Justice Sardar Mohammad Raza Khan to ascertain whereabouts of the unaccounted for persons from among the 35 missingpersons.

On Wednesday, the advocate general assured the court that the Raza commission would complete its inquiry in 30 days and that action would be taken against those responsible for removing the 35 missing people.

The court noted in its order that the advocate general KP had assured that the provincial government was aware of its responsibility of protecting fundamental rights of citizens as guaranteed in the Constitution.

It noted that as enforcer of the constitution, it was also fully cognizant of the responsibility and that both the law officers of the respective governments had been categorically told that the court had no option of overlooking the violation of the fundamental rights of the missing persons.

If no action as envisioned under the law and the Constitution was taken, the court would be constrained to take appropriate action without any consideration for the restraint which it had exercised till now, cautioned the court in unequivocal terms.

`Next time do not have any expectation from us, the court warned before postponing the hearing till Feb 11.
