Hit-and-run suspect escapes from court after bail dismissal

KARACHI: A suspect managed to escape from the courtroom after a sessions court on Friday dismissed his pre-arrest bail in a hit-and-run case.
Two suspectsthe car owner, Muhammad Fayyaz, and his driver, Muhammad Zia alias Shahzaibhad filed pre-arrest bail applications before Additional District and Sessions Judge (Central) Abdul Hazeef Lashari.
After hearing arguments from complainant`s counsel Jibran Nasir and the defence side, the court dismissed Shahzaib`s bail plea. However, following the announcement of the order, the suspect fled from the courtroom.
Meanwhile, the judge granted bail to Fayyaz against a surety bond of Rs130,000 without touching the merits of the case.
After the proceedings, the complainant`s counsel, Nasir, told the media that since the incident, the complainant`s wife, Uzma, was still on a ventilator, while the complainant had also sustained multiple injuries. He said that after the completion of the investigation, relevant sections would be included in the case.
Regarding the driver who fled from the courtroom, Advocate Nasir said that during the bail application hearing, the Investigation Officer (IO) was not present to arrest the suspect. It seemed that the IO was allowing the suspect to obtain bail from the high courts, he added.
He further mentioned that the IOhad not yet recorded the statements of the witnesses and the complainant under Section 161 of the CrPC.
During the hearing, the defence counsel contended that the alleged sections were bailable and did not fall within the prohibitory clause and the applicants were entitled to be granted bail on that consideration. He claimed the applicant Fayyaz was present at home when the incident occurred and there was no direct evidence available against the applicant.
According to the FIR, on May 19, the complainant Firasat Hussain Jami, along with his wife Uzma Firasat, 47, were en route towards their home on a motorcycle after meeting their relatives. Meanwhile, a black Vigo coming from behind hit them near Saima Bridge, Nazimabad No. 2, causing serious injuries to both of them.
Subsequently, they were immediately shifted to a hospital. However, as the public gathered, the driver, car owner, and others fled the scene, the complainant informed the police.
Meanwhile, unknown individuals present at the scene set the Vigo on fire.
The case was registered at Nazimabad police station under Sections 337-G (punishment for hurt by rash or negligent driving), 427 (causing damage to the amount of fifty rupees), 279 (rash driving or riding on a public way), 109 (abetment), 435 (mischief by fire or explosive substance with intent to cause damage), 34 (common intention) of the Pakistan Penal Code.
