Provisional Constitution

2022-09-03
THE Pakistan (Provisional Constitution) Order, an adaptation of the Government of India Act, 1935, published in the Gazette of Pakistan in Karachi, has done away with expressions like `in his discretion` and `exercising his individual judgement`, found in the India Act.

Neither the Governor-General nor the provincial Governors will have any special responsibilities. ... Another important feature is the absence of any reference to the King anywhere.

All appointments, including those of the provincial Governors and High Court Judges, will be made by the Governor-General. In the oath of af firmation, too, a judge or a member of a legislature has to swear allegiance to the Pakistan Constitution and not to the Crown.

[Meanwhile, as reported from New Delhi,] One of the aspects of the India-Pakistan agreement on income tax ... is that this agreement does not provide for relief or refund after an assessee has been charged income tax by both Dominions, but on the contrary avoidance of such relief or refund. ...[T]he assessee would also have to declare his world income, but each Dominion will tax him only on such portion of that income as has been agreed by both Governments to have accrued or arisen in the area of each.-DawnKarachi
