Plea for Sana`s disqualification dismissed

LAHORE: The Lahore High Court on Thursday dismissed for being not maintainable a petition seeking disqualification of Punjab Law Minister Rana Sanaullah for his alleged anti-judiciary speeches.

Majlis Wahdatul Muslimeen`s deputy secretary Abbas Nasir had filed the petition, pleading that the law minister gave derogatory remarks against the judge who conducted judicial inquiry into the 2014 Model Town incident.

He said the minister through his remarks attempted to malign and scandalise the judiciary.

The petitioner pleaded that as the law minister also violated the oath of his of fice by scandalising state institution, he be declared ineligible to remain member of the provincial assembly.

Justice Shahid Karim observed that the court did not disqualify anyone on the basis of mere allegations and press clippings.

He said the petitioner should approach the election commission under the relevant law regarding disquahncadon of a parliamentarian.

The judge dismissed the petition for being not maintainable before the high court.

ADJOURNED: The LHC adjourned hearing of a petition moved by the Pakistan Awami Tehreek, challenging `The Elections Act 2017`.

As Chief Justice Syed Mansoor Ali Shah resumed the hearing, a law officer stated an identical petition had also been filed before the Supreme Court. He said the court should wait for the decision by the apex court.

At this, the CJ adjourned hearing for two weeks.

In the petition, PAT leader Advocate Ishtiaq Chaudhry pleaded the amendments to the election law were introduced to benefit an individual (Nawaz). He said the person-specific legislation would weaken the democracy and democratic institutions in the country.

He asked the court to strike down sections 203 & 232 of the Election Act for being repugnant to the Constitution and also restrain the ECP from issuing a notification declaring Nawaz as PML-N head.
