Offence of rape added in Baloch girls kidnapping case

KARACHI: A judicial magistrate on Thursday issued non-bailable warrants for the arrest of two men allegedly involved in a case pertaining to the kidnapping of three underage Baloch girls in Azizabad`s Bhangoria Goth.

Police also incorporated Sections 376 (punishment for rape) and 337-J (causing hurt by means of a poison) of the Pakistan Penal Code (PPC) in the FIR after a medical report confirmed that two of the three girls were sexually assaulted.

They charge-sheeted three suspects and left out as many others for want of evidence.

The kidnapping took place on Sept 7 and the captives were recovered on Oct 19 in Sukkur.

Two of the three Baloch girls informed the court a couple of days later that they were forcibly married off after being abducted.

Initially, the police arrested two suspects for kidnapping the girls. But the investigation officer submitted a report in court a few days ago in which he charge-sheeted one detained suspect for allegedly kidnapping the girls and named two suspects as absconders for forcibly marrying the two of the three victims.

The victims have also named them in their statementsrecordedunder Section164 of the criminal procedure code by a judicial magistrate, the report added.

However, the IO did not charge-sheet the second detained suspect and two others and stated in the report that the captives did not nominate them and no other evidence wasavailable on record to connect them with the alleged offence.

The charge-sheet said that as per the medical reports two of the captives were found sexually assaulted and thus, Sections 376 and 337-J of the PPC were incorporated in the case.

It further added that the victims, related to each other, in their statements deposed that they were going to a bool(shop when a suspect met them on their way and offered them water.

They added that they fell unconscious after consuming the water and when they regained consciousness, they found themselves detainedin aroom. They also deposed that two of them were forcibly married off to as many absconding suspects.

The IO placed seven witnesses in the charge-sheet.

He did not incorporate the relevant section of the Sindh Child Marriages Restraint Act, 2013 despite the fact that the victims were said to be below 18.

After admitting the investigation report, a judicial magistrate (central) issued nonbailable warrants for the arrest of the absconders till Nov 11 and also ordered the jail authorities to release a held suspect if not wanted in any other criminal case.

A case was registered under Sections 364-A (kidnapping or abducting a person under the age of 10), 365-B (kidnapping or abducting or inducing a woman to compel her for marriage, etc) and 34 (common intention) of the PPC on the complaint of the father of one of the victims at the Azizabad police station.
