AS the political crisis continues in the country, the government has been complaining that Constitution is being rewritten by `a few judges`. This is mainly because of the hearing of critical cases of public importance repeatedly by the same bench. Some legal experts and politicians have expressed their concerns on what they perceive isinterferencein parliament`s domain, which happened earlier as well.
There has been aheated debate on whether the judiciary should interfere in the affairs of the legislature. In terms of democratic norms, it is obvious that the power to amend the Constitution rests with parliament.
Looking at the political chaos in the country, it is imperative to amend the Constitution in order to avoid any political crisis in the future. Some of the states framed their laws by 1(eeping in view their environmental restraints, but Pakistan is among the ones that followed in the footsteps of leading democracies, ignoring their political conditions while constituting the basic structure of the Constitution.
Concerning ethics and moral values, there are many problems in our society. On the political scene, defection of party members is an issue that has been long discussed by many. No political party has ever tried to help create a political environment that may keep such incidents out of the acceptance domain.
It is imperative that legislators come together for the sake of democracy and declare parliament as the supreme institution. They should be the ones to carrying the burden ofcases regarding public importance on their shoulders, leaving no room for judicial activism.
