NBW issued against chemical examiner for defying court order

HYDERABAD: The Hyderabad model criminal trial court on Monday took serious notice of continued absence of chemical examiner who had been asked to appear before it in a case pertaining to the murder of a Jeay Sindh Qaumi Mahaz (JSQM) activist, Gul Bhatti, 15 years ago.

Issuing a non-bailable warrant against the chemical examiner, the court also ordered a police team to proceed to Karachi, arrest him and produce him before it during the course of the day`s proceedings.

The court of Additional District Judge-IMohammad Ahsan Khan Durrani has been designated as the model criminal trial court by the apex court. It has been holding the trial on a day-to-day basis to conclude it within five days.

Gul Bhatti case was fixed for Monday (today) for examination of Sindh government`s chemical examiner, who is presently posted at Karachi.

He was earlier directed to appear before court, following submission of an application under Section 540 of the Criminal Procedure Code (CrPC) by the prosecution, to submit the chemical examination report.

Judge Durrani on Friday asked focal person of the director general of Sindh health services to tell him (Dr Masood Solangi) to appear before the court and make a statement.

Dr Solangi rushed to the court from Karachi on Saturday. He was directed to write to the chief secretary for disciplinary action against the chemical examiner over his absence. TheDG complied with the order and the matter was adjourned for today but he (the chemical examiner) did not turn up on Monday.

The court viewed his defiance seriously and ordered dispatch of a police team to Karachi for his arrest. The team headed by the Qasimabad SHO proceeded to Karachi, where the chemical examiner undertook to appear before the court on Tuesday.

Gul Bhatti, son of Parwano Bhatti, was murdered on July 28, 2004 in the area of Qasimabad police station. The FIR of the incident was registered the next day and a charge-sheet was submitted in court on Sept 22, 2005. The complainant, who expired a few years back, had nominated six suspects, including a Pakistan Peoples Party-Shaheed Bhutto (PPP-SB) activist Dr Mazhar Memon, in the FIR.

During the course of investigation, police cleared four of the six suspects and submitted a charge-sheet against Dr Memon and JanMohammad who were present in court on Monday (today).

Meanwhile, senior JSQM activist Dr Niaz Kalani on Monday visited Bhai Khan Ghanghro village near Sukkur to offer his condolences to the family of Abdul Gafoor Ghanghro, who was killed recently. Ghafoor Ghanghro was the son of JSQM Arisar group`s joint secretary Ghulam Nabi Ghanghro, Our Sukkur Correspondentadds.

Speaking to local reporters, Dr Kalani said that that the deceased fell victim to a tribal feud. He said that bloodshed in such feuds had become a menace in which feudal lords and the provincial police were involved.

`While these feudal lords regard people as their slaves, the police have made bloodshed and compensation their business, he remarked.

He believed that the junior Ghanghro was killed to teach a lesson to hisfatherin order to deter him from doing nationalist politics.
