Police reject woman`s claim regarding brother`s murder

HYDERABAD: The police officers, named by a woman in her application as respondents in the case of her brother`s murder by them and CIA in-charges of Hyderabad and Khairpur Mirs, have filed their replies in the court of the seventh additional district and sessions judge rejecting her entire narration of the episode as totally false.

Hyderabad SSP Amjad Shaikh and Phulelli SHO Ayaz Bughio on Tuesday submitted their almost identical replies in the court. The Hyderabad complaint cell DSP also endorsed the police officers` contentions.

The judge, Naveed Ahmed Soomro had on Thursday sought comments of the SSP and reports from the other respondent police officers on the application of Ms Reshma, who had alleged that her brother Farhan Siyal was kidnapped by police on March 11 and shot dead by two CIA officers, Hanif Khoso and Muneer Abbasi, and Phulelli SHO Ayaz Bughio, in front of her and herfamily on March 28. She stated in her application that the police officers had already received Rs10 million as ransom for his release and were demanding another Rs2 million.

She also narrated the whole ordeal.

In his statement filed in the court on Tuesday, SSP Amjad Shaikh rejected all her allegations, termed them `superficial` and prayed the court to dismiss her application for the registration of a murder FIR against the nominated police officers.

The court would hear the matter on April 15.

The SSP informed the court that he had called a report from the Phulelli SHO, who submitted the same mentioning that on March 28 he along with a police party left the police station for patrolling. According to the SHO, said the SSP, the police party saw three suspects riding a motorcycle near Faizan-iMadina Chowk and signalled them to stop but they fired on police team which was returned in self-defence.

After a brief encounter, one person fell from the motorcycle and two others fled. The injured suspect was arrested and later identified as Farhan Siyal. An unlicensed pistol was seized from him and he was shifted to the civil hospital, where he was pronounced dead, the SHO was quoted as reporting.

The SSP said that the SHO`s report showed that Siyal was a notorious crim-inal involved in many cases registered against him at the GOR (Hyderabad), Khairpur Mirs and Jamshoro police stations. He was charge-sheeted in two criminal cases in which he was declared proclaimed offender. One of them was the high-profile murder case of judge Agib Shahani`s son lodged at the GOR police station, the SHO said.

The SSP further stated that the Phulelli SHO collected Farhan`s criminal record which showed seven cases registered against him in Hyderabad, Jamshoro and Khairpur Mirs districts.

The suspect was operating a gang of criminals, according to the SHO, who obtained calldatarecords ofinspectors Hanif Khoso, Muneer Abbasi, Ayaz Ali Bughio and Ms Reshma.

The SSP argued that the applicant did not mention the time of the alleged murder in her application; and according to the CDR, Hanif Khoso was present in Khairpur, Muneer Abbasi and Ayaz Bughio were present at different locations while the applicant was present in Karachi.

The SSP said none of them was present in the area of the Hatri police station as was claimed by the applicant.

Ms Reshama had narrated a fabricated story in her application to pressure police, the SSP added.

He said the applicant did not approach the police station concerned before moving this court. An application dated April3 was received by the DSP complaint cell on April 5. She was called for an inquiry but she did not appear. One male person attended her cellphone and said that he would appear for the inquiry after consulting some lawyer, the SSP said.

He argued that how it was possible that Farhan was shot dead by police in front of his own relatives. He wondered why the applicant did not approach police when Farhan was picked up on March 11 and then allegedly killed on March 28.

SHO Bughio in his almost identical statement and narrated his own account of the alleged encounter that, according to him, took place on March 28 on Faizani-Madina road near new Faqir Chowk. He said an FIR was registered against him.

He said Farhan had played an active role in the high-profile case of judge Agib Shahani`s son.

The Hyderabad complaint cell DSP also submitted his statement containing the `inquiry proceedings`. He said that the CIA in-charges of Hyderabad and Naseem Nagar police post and SHOs of Qasimabad, Phulelli and Bhitai Nagar police stations submitted their reports vehemently denying the allegations against them. He shared details of the CDR of Ms Reshma, Hanif Khoso, Muneer Abbasi and Ayaz Bughio to dismiss the applicant`s claim. He also termed contents of the application false and frivolous.
