Petition seeks Achakzai`s disqualification as MNA

PESHAWAR: A PTI councillor of Peshawar Town-I on Tuesday move d the Peshawar High Court seeking orders for the disqualification of Pakhtunkhwa Milli Awami Party chief Mehmood Khan Achakzai as MNA for declaring that Khyber Pakhtunkhwa belongs to Afghans.

In a petition, Zahir Shah insisted Mr. Achakzai`s statement was amounted to high treason and therefore, the court should issue directions to the chief election commissioner and National Assembly speaker to disqualify him as MNA under Article 6 of the Constitution of Pakistan read with sections 123-A and 124-A of Pakistan Penal Code.

He also requested the court to ask the East Cantonment police station, Peshawar, SHO to register an FIR against Mr. Achakzai.

The respondents in the petition filed through lawyer Noroz Khan are Mr.

Achakzai, NA speaker and CEC.

The petitioner, who is also chairman of the Tehreek-iHaqoog-i-Khyber Pakhtunkhwa, said he was shocked to learn about the inimical language used by Mr. Achakzai against the state, especially Khyber Pakhtunkhwa.

He said the PkMAP chief had stated that Khyber Pakhtunkhwa was part of Afghanistan and it belonged to Afghans and that no Afghan was to be disturbed or displaced from KP.

The petitioner said as a MNA, Mr. Achakzai had taken the oath to remain faithful to the state of Pakistan and Constitution, but by giving the said statement, he had violated the terms of that oath. He said the NA speaker was bound to suspend the membership of Mr. Achakzai as MNA and send a letter to the Election Commission of Pakistan for his disqualification. The petitioner said the CEC was also bound to take action against the PkMAP chief and disqualify him for violating the Constitution and his oath of office.-Bureau Report
