PHC disposes of case against Ehtesab Commission

PESHAWAR: The Peshawar High Court on Tuesday disposed of a petition of former JUI-F Senator Haji Ghulam Ali in light of the closure of an inquiry by the KP Ehtesab Commission into his assets.

While deciding the case, a bench consisting of Chief Justice Mazhar Alam Miankhel and Justice Roohul Amin Khan Chamkani ruled that the KPEC had closed the inquiry challenged by the petitioner, so his petition had be come infructuous.

KPEC deputy prosecutor general Zahid Aman appeared before the bench and produced documents showing that the KPEC had closed the said inquiry.

On Oct 21, the court had granted interim relief to Haji Ghulam by stopping the KPEC from taking adverse action against him, including his arrest. The interim relief was extended by the court during the subsequent hearings into the petition.

The petitioner had requested the court to quash the initiation of the impugned inquiry against him as it was based on false allegations.

The petitioner has claimed on Oct 12, he received a phone call from the KPEC asking him to turn up there and that when he visited the KPEC`s office, he was handed over a pro forma and was asked to provide details about his assets within four days.

He said no written call-up notice was issued to him.

The petitioner said around 14 years ago, he was arrested by the NAB on the charge that his Rs315 million assets were disproportionate to the known sources of his income, but an accountability court acquitted him and the high court upheld the judgment.

He said the NAB later initiated inquiry into a property case against him that dated back to the days when he was the Peshawar district nazim.

The petitioner, however, said nothing proved against him and therefore, the said inquiry was closed in 2014.

He said the KPEC proceedings against him were based on mala fide intent.

Also, the bench disposed of the petition of a former Fata assistant political agent, Bakhtiar Mohmand, over the closure of a KPEC inquiry against him. Bureau Report
