JIT sought on plea for FIR against senior police officers

HYDERABAD: Additional District Judge-VII Naveed Ahmed Soomro on Saturday adjourned an application for seeking registration of FIR against Hyderabad and Khairpur Mir SSPs and several other policemen of the two districts for alleged murder of a suspect in, what was described as, `encounter`, to April 18.

Applicant Ms Reshma`s counsel Raja Jawad Ahmed said that he had no objection if court ordered investigation of the proposed FIR or even the encounter FIR (No. 38/23) by the Punjab police, a joint investigation team (JIT) was formed andthe body exhumed for autopsy. The court heard arguments of Faisal Bhatti and Ashfaq Khaskheli, the counsel for SHO AyazBughioandin-chargeCIAHyderabad Muneer Abbasi respectively, before adjourning matter.

According to Raja Jawad Ahmed, he contested the police statements filed by SSP Hyderabad Amjad Ahmed Sheikh and SHO Phulelli police station Ayaz Bughio. The counsel reiterated his claim that Farhan Siyal was picked up on March 11 and shot dead in a fake police encounter on March 28.

He disputed police`s story that Farhan Siyal was a proclaimed offender, and said police did not submit such report in court.

He said only a reference was mentionedabout the case of murder of a former judge Agib Shahani`s son. He pointed out that Farhan was not absconder in any case. He said most cases claimed by police were registered against him after his arrest; otherwise no FIR was registered against him in which he was nominated as accused. He said that police produced call data record (CDR) of one, Khuda Bux, while attributing it to be of applicant Ms Reshma`s cell number. He said that police did not attach CDR of Sajjan Siyal, brother of deceased, whereas according to Ayaz Bughio`s CDR he was constantly present at one location while in the FIR 38/23 he was shown to have been patrolling. He said it means FIR`s text was wrong.

He told court that police didn`t simplydiscuss transaction of Rs10m ransom that was transferred to one account by deceased`s family as per demand of police for the release of Farhan.

Pressing for exhumation of deceased`s body, he said that the deceased man received three bullets on his chest while as per the autopsy report, he was hit in the back. There was no exist point of bullet wounds at the back, he said, and added he would himself request judicial magistrate for exhumation even in fake encounter FIR 38/23 to establish his point.

Ms Reshma, Farhan`s sister, has sought registration of FIR against the SSPs, besides SHO Ayaz Bughio and CIA incharges of Hyderabad and Khairpur Mirs and others.
