Court cancels order to deny appointment of `embattled officer` in any hospital

HYDERABAD: The bench Sukkur of the Sindh High Court has rescinded its March 3 order that director of administration at Liaquat University Hospital (LUH) Hyderabad, Abdul Sattar Jatoi, shall not be posted in any teaching hospital of Sindh and a committee be formed to decide fate of his cadre.
The division bench comprising Justice Mohammad Iqbal Kalhoro and Justice Arbab Ali Hakro said that it would hear the applicant.
The bench had on Oct 12 ordered Sindh health department`s focal personto appear on Nov 28 and asked the petitioner to file an amended title of the petition, making him (Jatoi) as respondent in the case.
While passing the order against the applicant on March 3, the bench had referred to the orders of the Sindh Services Tribunal and Supreme Court in appeal against the tribunal`s judgment which had not only set aside the applicant`s promotion but also declared `re-designation` of a clinical side post of LUH as `director administration, accounts and development`illegal.
The applicant`s counsel Sarmad Hani informed the court that being aggrieved by March 3, 2023, ex-parteorder, he had approached the Supreme Court against it.
The SC observed such a remedy was available before the court which had passed the order. Hani pleaded that ex parte order was passed without issuing notice to the applicant and making him party to explain his position.
He said that neither was there material against the applicant nor was he provided an opportunity to offer explanation in the petitions. On March 3, the applicant was neither financial adviser/director finance nor had he defied the SC`s order, he said.
He prayed recalling the March 3 order and his restoration of the original position he was holding on March 3.
