Court seeks KMC opinion on internee`s post-mortem

PESHAWAR: A Peshawar High Court bench on Wednesday asked the Khyber Medical College`s forensic science department if postmortem could be performed on a detainee, who had died in a Fata internment centre over four years ago.
Chief Justice Yahya Afridi and Justice Mohammad Ayub Khan fixed June 20 for the next hearing into Mahida Bibi`s petition seeking the postmortem of her husband, Maula Jan, who had died in an internment centre in 2013, and payment of compensation for his death in custody.
The bench directed the KMC`s forensic science department to produce written opinion on the matter before the next hearing.
The petition has been pending decision for many years.
The petitioner claimed that her husband was taken into custody by security forces in Mohmand Agency on Jan 17, 2011.
She added that her husband remained missing thereafter until Aug 16, 2012, when he was shifted to an internment centre in Ghalanai, Mohmand Agency.
The petitioner said the internee had later died in custody and that his body was handed over to the family on Feb 10, 2013.
She claimed that the family was told by Mohmand Agency`s administration that the detainee had died a natural death but the body carried marks of torture.
During a hearing, the lawyer for tribal administration had said the Ghalanal internment centre was controlled by the Mohmand Rifles, which handed over the body to the administration.
The bench has also been looking into the petitioner`s point if the legal heirs of the deceased should be paid compensation or diyat (blood money).
GIRL`S PRODUCTION ORDERED: The bench also directed the political agent of Khyber Agency to produce a girl, whose family members claimed that she had been kidnapped from Swat district and was forced to marry a person in Bara area of Khyber Agency.
It ruled that the girl be produced today (May 18).
Petitioner Jahanzeb Khan claimed that his daughter was kidnapped by Shah Faisal of Swat and that he got an FIR registered against him at Bahrain police station.
Qazi Jawad Ahsanullah, lawyer for the petitioner, said the suspect had challenged the registration of FIR in the high court, which quashed it without putting his client on notice to plead his case.
He said the girl was not happy with the `forced marriage` and therefore, she should called to the court to confirm it.
The lawyer said it was a case of forced marriage, which was illegal, and therefore, the court should take necessary action for the girl`s relief.
