THE jirga system violates human rights, and exists in violation of Article 10A of the Constitution. The motive behind the 25th Amendment to the Constitution was to bring the under0developed, neglected and excluded parts of the erstwhile Federally-Administered Tribal Areas (Fata) into the national mainstream.
Apparently, the federal government has failed in governance, and it seems to be under pressure from terrorist outfits active in the region that have been demanding the annulment of the 25th Amendment.
Instead of giving in to such demands, the government should accept its failure and sincerely devise a strategy that would bring inclusive development, benefitting every citizen of the state. How can the state leave its citizens at the mercy of the jirga system? Is it not like betraying the people? The federal government must make due investments in the human capital of the region, and make sure that all state institutions are aligned with the Constitution.
