LAHORE: The Lahore High Court (LHC) on Thursday reserved its verdict on a petition by wife of Pakistan Tehreek-i-Insaf President Parvez Elahi seeking contempt proceedings against the Islamabad commissioner and inspector general of police for arresting her husband despite a restraining order.
Earlier, Justice Sultan Tanvir Ahmad questioned the non-appearance of both officers the commissioner and the IGP despite a strict warning issued at the last hearing.
The advocate general of Islamabad informed the court that the commissioner and the IGP could not make it to Lahore due to their appearances before the Supreme Court.
He said the Islamabad police had arrested Elahi and the Islamabad High Court did not declare the arrest illegal.
The law officer said the officers apologised to the court in writing.
Petitioner`s counsel Aftab Bajwaasked the court to appoint him a bailiff and he would arrest the Islamabad commissioner and the IGP.
However, the judge responded to the lawyer, saying that he may bring someone else.
The judge asked the advocate general of Islamabad that the officers should have appeared before the court.
The judge regretted that the`afsar shahi`(the bureaucrats) did not appear in court despite arrest warrants.
He said the only solution was to issue a direction to the secretary establishment.
Justice Ahmad asserted that legislation should be enacted to impose penalties on those government servants who do not appear in court.
The judge reserved his verdict on the contempt petition of Qaisera Elahi.
The Islamabad police had on Sept 1 rearrested PTI President Elahi near his Gulberg residence soon after the LHC set him free with a restraining order against his possible arrest or detention by any agency and the government.
