Street criminal sentenced to seven years in prison

KARACHI: A sessions court has sentenced a street criminal to seven-year rigorous imprisonment in a casepertainingtomuggingof a citizennearAl-Mustafa Hospital, Khokhrapar.

Additional District and Sessions Judge (East) Shahid Ali Memon pronounced the judgement after recording the evidence and hearing arguments from both sides.

The judge convicted Nisar Ali Khan alias Dilshad Ali Khan of committing an armed robbery and ruled: `The accused after his arrest had remained in jail and later on, he got bail... his bail bond stands cancelled and his surety is discharge.

The court put the case of absconding accused Faraz on dormant file. He would be tried for the robbery after his arrest.

`Based on the comprehensive analysis of the evidence presented by both parties, it is evident that the prosecution has established its case beyond a reasonable doubt. The testimony of the witnesses, supported by corroborative evidence and investigative finding, convincingly implicates the accused in the commission of the crime,` the court observed.

According to the prosecution, the complainant statedbefore police that in January 2021, while returning from work, two street criminals riding a motorcycle stopped him at gunpoint and robbed him of a laptop, mobile phones and other personal belongings.

Five months later, one of the snatched mobile phones was recovered and the buyers of the mobile phone emerged as prosecution witnesses against the accused. They subsequently identified the accused in the court.

During the trial, state prosecutor S. Khursheed Bukhari argued that prosecution witnesses had fully substantiated their case on all major points, connecting the accused with the crime beyond any doubt. He urged the court to convict the accused.

On the other hand, the accused claimed that the police had falsely implicated him due to personal enmity. He alleged in his statement before the court that the police had taken him in custody from his residence two years ago and demanded bribe, but when he refused, they implicated him in that case.

The court rejected his plea as he failed to highlight discrepanciesin the case ofthe prosecution.

`The witnesses rightly identified the accused person in the open court. The case property was also identified by the witnesses. Even no contradictions with regard to date, time, place and course of investigation have come on record,` the court observed.
