Ayyan again moves SC over name in ECL

ISLAMABAD: Model Ayyan Ali filed in the Supreme Court on Friday another petition accusing the government of defying the court`s April 13 order of removing her name from the exit control list (E CL).

In the petition filed by her counsel Sardar Latif Khosa, the model alleged that the state employees had behaved like servants of the government rather than public ones by placing her name in the ECL hours after the SC judgement.

`The extreme mala fide acts of the respondents clearly amounted to overreaching the order of the apex court as a result of which the entire judicial system stood ridiculed,` she regretted.

The petition has named Interior SecretaryArif Ahmed Khan, Additional Secretary ECL (interior ministry) Mohammad Asghar Chaudhry, Additional Director of FIA Jinnah International Airport Shahid Hayat, Director General FIA Headquarters, Islamabad, Mohammad Amjad, DG Passport Immigration Headquarters, Islamabad, Usman Iftikhar Bajwa, Federal Board of Revenue Chairman Nisar Mohammad Khan and Collector Customs (adjudication), Customs House Islamabad, Mohammad Ali Raza as respondents.

On April 13, the Supreme Court had upheld the Sindh High Court`s March 7 decision of removing Ayyan Ali`s name from the ECL with an observation that the apprehension that removal of the model`s name from the ECL would amount to letting her off for good was misconceived.

Subsequently, the petition said, AyyanAli had obtained a confirmed ticket for Dubai via a PIA flight on April 20. When she reached the Jinnah Airport at 10.30pm, a large contingent of FIA and customs officers under the command of the FIA DG and the collector customs had stopped her from entering the departure lounge, it added.

The petition said the model was accompanied by her lawyer and they showed the orders of the Supreme Court, the high court and the customs court to the officers, but they said they had been directed not to allow her to board the plane.

The petitioner accused the FBR chairman of placing her name back on the ECL. Ayyan Ali regretted that while everyone had forthrightly facilitated retired Gen Pervez Musharraf in his travel abroad despite the heinous offences committed by him, she wasobstructed and deceived.

Both her confirmed tickets went waste causing her financial loss and if she did not make it to Dubai to meet her contractual obligation she would suffer irreparably, the petition said.

The model contended that the respondents had compounded the contempt, magnified and glorified their authority and rendered rule of law completely subservient to their whims.

Earlier on April 18, Ayyan Ali had filed a petition requesting the Supreme Court to initiate contempt proceedings against the government for not removing her name from the ECL despite the April 13 order.

The contempt petition had named the interior secretary, the additional secretary ECL and the additional director of FIA, Jinnah International Airport, as respondents.obstructed and deceived.
